Terms and Conditions
Welcome to JanGan!
JanGan Connect Pvt Ltd which will be represented as JanGan in this document (which refers to the app, web and integrated components) is offered as a public service that will enable Indian residents to nurture an online ecosystem for information sharing, learning, and multi-point dialog to foster mutual understanding and enhance the democratic process within our republic. Please feel free to let your friends, family and acquaintances know about JANGAN and how it can help them improve their communities through the exchange of information, ideas and points of view.
Description of Services
JanGan is available as an application or 'app' for Apple® and Android® devices as well as for most popular web browsers. The functionality across platforms is substantially similar, depending on the functions permitted within each device and operating system. A single user profile enables the User to login and use JanGan within the device or browser of choice.
JanGan requires that each User hold his or her own account which is linked to the permanent resident address of that individual. We require that the information entered upon registration be true and authentic. Only one account is permitted per individual and that individual is required to use his/her true legal name and that the Username reflect clearly the User’s actual name.
JANGAN User subscriptions are available free of charge (JANGAN Free). Upon registration, Users will be able to use the JANGAN Free and will be able to consider upgrading to the premium and power user configurations from within the JANGAN app. JANGAN Free includes advertising that is intended to be relevant to the user, based on his/her profile and interests.
These Terms of Service (“Terms”) govern your access to and use of our services, including our various websites, SMS, email notifications, applications, buttons, widgets, ads, commerce services, and other covered services that link to these Terms (collectively, the “Services”), and any information, text, links, graphics, photos, audio, videos, or other materials or arrangements of materials uploaded, downloaded or appearing on the Services (collectively referred to as “Content”). By using the Services you agree to be bound by these Terms.
Who May Use This Service
You may use the Service only if you agree to this binding contract (Terms) with JanGan and are not a person barred from receiving services under the laws of the any applicable jurisdiction. In any case, you must be at least 13 years old to use the Service. If you are accepting these Terms and using the Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so and have the authority to bind such entity to these Terms, in which case the words “you” and “your” as used in these Terms shall refer to such entity.
The JanGan end-user (User) configuration of the Services requires one and only one authorized account per user and this user must be an individual person who resides within the INDIA as his/her current primary residence. Each User must declare their actual residential address as indicated in their current official government issued identification or in the event of non-adult users, the official address of the parent(s) or legal guardian(s) with whom the User resides. JANGAN requires that the actual complete name, as indicated in the official identification, of the User is entered upon registration into the Service. JANGAN will generate a user identification string (JANGAN User ID) which incorporates the User’s name along with a numeric suffix in order to create a unique identifier. The User must not substantially modify this identifier in order to appear anonymous to the JANGAN community. Your use of this Service requires that your participation and any Content posted by you, are linked with your actual identity.
If you are using the Service as a or on behalf of an official entity, such as an elected official (Rep) or an authorized organization (Org) you must use a separate registration onboarding process as indicated within the Service. A Rep or Org may authorize a limited number of individuals to enter Content into the Service. In the event an individual, so authorized, enters any Content within the Service, both the registered User and the authorized individual are responsible for any such Content.
In no event shall any User attempt to use the Service under a false identity or on behalf of another User unless explicitly authorized to do so. JanGan takes fraudulent use seriously and will promptly terminate the account of any User who uses the Service under false pretenses or violates the Community Rules. Additionally, any use of the Service that appears to violate applicable laws is subject to referral to the appropriate law enforcement authorities within the User’s legal jurisdiction.
Your License to Use JANGAN; Grant of Rights In Content
JanGan hereby gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the JanGan platform (app, web and integrated components otherwise referred to as “Platform”) provided to you as part of the Services. This license has the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by JanGan Platform, in the manner permitted by these Terms.
The Services are protected by copyright, trademark, and other laws of both the India and where and when applicable, foreign countries. Nothing in the Terms gives you the right to use the JanGan or JanGan names or any of the JanGan trademarks, logos, domain names, and other distinctive brand features. All right, title, and interest in and to the Services (excluding Content provided by users) are and will remain the exclusive property of JanGan and its licensors. Any feedback, comments, or suggestions you may provide regarding JanGan, or the Services is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.
You are responsible for your use of the Services and for any Content you provide, including compliance with applicable laws, rules, and regulations. You should only provide Content that you are comfortable sharing with others, which will be linked to your own authenticated identity. Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. All Content is the sole responsibility of the person who originated such Content.
We may not always monitor or control the Content posted via the Services and, we cannot take responsibility for such Content. We reserve the right to remove Content that violates this Agreement, including for example, copyright or trademark violations, impersonation, unlawful conduct, harassment and the Community Rules. If you believe that your Content has been copied in a way that constitutes copyright infringement, please report this through the feedback feature.
Except as otherwise set forth in a specific contract between you and JanGan, you retain your rights to any Content you submit, post or display on or through the Services which legally belongs to you. What’s yours is yours — you own your Content (and your incorporated audio, photos and videos are considered part of the Content). By submitting, posting or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sub-license) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed). Unless Content is sent by Direct Message (otherwise referred to as Chat) within the Platform, this license authorizes us to make your Content available to the rest of the User community and to let others do the same. You agree that this license includes the right for JanGan to provide, promote, and improve the Services and to make Content submitted to or through the Services available to other companies, organizations or individuals for the syndication, broadcast, distribution, promotion or publication of such Content on other media and services, subject to our Terms for such Content use. Such additional uses by JanGan, or other companies, organizations or individuals, may be made with no compensation paid to you with respect to the Content that you submit, post, transmit or otherwise make available through the Services.
JanGan has a specific yet evolving set of rules for how ecosystem partners can interact with your Content on the Services. These rules (otherwise referred to as Community Rules) exist to enable an open ecosystem with your rights in mind. You understand that we may modify or adapt your Content as it is distributed, syndicated, published, or broadcast by us and our partners and/or make changes to your Content in order to adapt the Content to different media.
You represent and warrant that you have, or have obtained, all rights, licenses, consents, permissions, power and/or authority necessary to grant the rights granted herein for any Content that you submit, post or display on or through the Services. You agree that such Content will not contain material subject to copyright or other proprietary rights, unless you have necessary permission or are otherwise legally entitled to post the material and to grant JanGan the license described above.
Using the Services
Please review the JanGan Community Rules, which are part of this Agreement and outline what is prohibited in the Services. You may use the Services only in compliance with these Terms and all applicable laws, rules and regulations.
Our Services evolve constantly. As such, the Services may change from time to time, at our discretion. We may stop (permanently or temporarily) providing the Services or any features within the Services to you or to users generally. We also retain the right to create limits on use and storage at our sole discretion at any time. We may also remove or refuse to distribute any Content on the Services, suspend or terminate Users, and reclaim usernames without liability to you.
In consideration for JanGan granting you access to and use of the Services, you agree that JanGan and its third-party providers and partners may place advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others. You also agree not to misuse our Services, for example, by interfering with them or accessing them using a method other than the interface and the instructions that we provide.
You may not do any of the following while accessing or using the Services: (i) access, tamper with, or use non-public areas of the Services, Platform, JanGan’ computer systems, or the technical delivery systems of JanGan’ providers; (ii) probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures; (iii) access or search or attempt to access or search the Services by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by JanGan (and only pursuant to the applicable terms and conditions), unless you have been specifically allowed to do so in a separate agreement with JanGan. Crawling the Services and scraping its content without the prior consent of JanGan is expressly prohibited; (iv) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive or false source-identifying information; or (v) interfere with, or disrupt, (or attempt to do so), the access of any User, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing the Services, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on the Services.
We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of JanGan, its Users and the public. JanGan does not disclose personally identifying information to third parties except in accordance with our
Privacy Policy.
If you deploy the advertiser features of the Services, you must agree to our JanGan Authorized Advertiser Addendum.
You are responsible for safeguarding your account, in part by using a strong password and limit its use to this account and by avoiding sharing this password with others. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above.
You can control most communications from the Services. We may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the Services and your account, and you may not be able to opt-out from receiving them. If you added your phone number to your account and you later change or deactivate that phone number, you must immediately update your account information to help prevent us from communicating with anyone who acquires your old number.
The Content of Others
Much of the Content on our Services is produced by Users, publishers, and other third parties. Whether that Content is posted publicly or sent privately, the Content is the sole responsibility of the person or organization that submitted it. Although JanGan reserves the right to review or remove all Content that appears on the Services, we do not necessarily review all of it. So, we cannot—and do not—take responsibility for any Content that others provide through the Services. Through these Terms and our Community Rules, we make clear that we do not want the Services put to adverse uses. But because we do not review all Content, we cannot guarantee that Content on the Services, or that our Users’ use of our Services, will always conform to our Terms and/or Community Rules.
Respecting Others' Rights
JanGan respects the rights of others and we believe you should also. You therefore may not use the Services, or enable anyone else to use the Services, in a manner that: violates or infringes someone else’s rights of publicity, privacy, copyright, trademark, or other intellectual property right, bullies, harasses, or intimidates, defames, spams or harmfully solicits our Users. You must also respect JanGan and JANGAN’s rights and adhere to the brand guidelines published by JanGan.
Safety
By using the Services, you agree that: You will not use the Services for any purpose that is illegal or prohibited in these Terms. You will not use any robot, spider, crawler, scraper, or other automated means or interface to access the Services or extract other Users’ information. You will not use or develop any third-party applications that interact with the Services or other Users’ Content or information without our written consent. You will not use the Services in a way that could interfere with, disrupt, negatively affect, or inhibit other Users from fully enjoying the Services, or that could damage, disable, overburden, or impair the functioning of the Services. You will not use or attempt to use another User’s account, username, or password without their explicit permission. You will not solicit login credentials from another User. You will not post Content that contains or links to pornography, graphic violence, threats, hate speech, or incitements to violence. You will not upload viruses or other malicious code or otherwise compromise the security of the Services. You will not attempt to circumvent any content-filtering techniques we employ or attempt to access areas or features of the Services that you are not authorized to access. You will not probe, scan, or test the vulnerability of our Services or any system or network. You will not encourage or promote any activity that violates these Terms. We also care about your safety while using our Services. So do not use our Services in a way that would distract you from obeying traffic or other safety laws.
Your Account
You are responsible for any activity that occurs in your JANGAN account. So, it’s important that you keep your account secure. One way to do that is to select a strong password that you don’t use for any other account. By using the Services, you agree that, in addition to exercising common sense: You will not create more than one account for yourself. You will not create another account if we have already disabled your account, unless you have our written permission to do so. You will not buy, sell, rent, or lease access to your JANGAN account nor any content, JANGAN username, or a follow link without our written permission. You will not share your password. You will not log in or attempt to access the Services through unauthorized third-party applications or clients. If you think that someone has gained access to your account, please immediately reach out to JANGAN Support.
Data Charges and Mobile Phones
You are responsible for any mobile charges that you may incur for using our Services, including text-messaging outside of the Platform and data charges. If you’re unsure what those charges may be, you should ask your service provider before using the Services. If you change or deactivate the mobile phone number that you used to create a JanGan account, you must update your account information through Settings immediately (within at most 72 hours) to prevent us from sending to someone else messages intended for you.
Privacy Policy
We believe you should always know what data we collect from you and how we use it, and that you should have meaningful control over both. We want to empower you to make the best decisions about the information that you share with us. That’s the basic purpose of this Privacy Policy.
You should read this policy in full, but here are a few key things we hope you take away from it:

JanGan is a public service and (unless via Direct Message) Content that Users post is immediately searchable and discoverable by other Users unless you block them. We give you non-public ways to communicate on JanGan too, through protected Direct Message (referred to as “Chat” in the Platform).

When you use JanGan, even if you’re just viewing content others post, we may receive some personal information from you like the type of device you’re using, your home address and your internet protocol (IP) address. You can choose to share additional information with us like your, address book contacts, and a public profile. We use this information for things like keeping your account secure and showing you more relevant Content, people to follow, events, and ads.

We give you control through your settings to limit the data we collect from you and how we use it, and to control things like account security, marketing preferences, apps that can access your account, and address book contacts you’ve uploaded to JanGan. You can also download the information about you that we have stored on JanGan upon proper verification of identity.

In addition to information you share with us, we may use the Content you post, Content you’ve read, reacted to, or forwarded, and other information to determine what topics you’re interested in, your age, the languages you speak, and other signals to show you more relevant content. We give you transparency into that information, and you can modify or correct it at any time.

If you have questions about this policy, how we collect or process your personal data, or anything else related to our privacy practices, we want to hear from you. You can contact us at any time through the JanGan Support contact or Feedback links.

JanGan owns and retains all the intellectual property rights to the summarised content made available to you through the App but JanGan but does not claim ownership rights to the original sources of information, which are instead held by the sites to which the App may link You.

If you view or click on such content source, you acknowledge and understand clicking on the content will redirect you to the original publisher’s page.

The Content posted on the Platform may be sourced from third party providers. JanGan holds no control with respect to the content and does not warrant the correctness, validity or legality of the Content. JanGan expressly disclaims all warranties and shall not be liable for any violations under civil or criminal law. JanGan is not responsible for any third-party Content, applications, services, advertisements, and/or links that may be contained in the App.

Further, we use third-party news companies to serve online news when you use the App or Services. When you interact with these services, they may collect information from and about you and your interaction with their content. Please be aware that they may track your activity using cookies or similar technology, in order to provide services of interest to you.

The JanGan app exhibit the following mandir feature which includes aartis, bhajans, mantras along with pictures, artwork, software, 3D photograph etc., in the media room and other places on the platform are copyright protected. All rights are reserved.

Every effort is made to ensure the app is up to date and accurate, no legal liability or other responsibility is accepted by or on behalf of the JanGan app. The JanGan app accepts no responsibility for any loss, damage or inconvenience caused as a result of such information.
We require certain information to provide our services to you. For example, you must have an account in order to upload or share Content on JanGan. When you choose to share the information below with us, we collect and use it to operate our services.
Basic account information
You must have to create an account to use our Services and in order to create an account, you must provide us with some personal data so that we can provide our services to you. This includes (1) your full, legal name as it appears on your official government issued identification, (2) your mobile device phone number, (3) your residential address, which should be the same address you use for registering to vote (if applicable) and which is necessary to determine your elected representatives, voting locations and jurisdictions, (4) your date of birth, (5) a password, and (6) your email address. JanGan will automatically create your username based on your full name plus a four-digit number to ensure it is uniquely your own. You may not remove your first and last name from the username. You must have only one account and must not attempt to participate in JanGan anonymously, although you may choose to block specific users and only receive Direct Messages from those whom you follow and vice versa.
Profile Information
In addition to the basic information required for your account, we ask you to include the following optional fields in order to fine tune the content we organize for optimal relevance (subject to reduction, augmentation or adjustment): (1) children’s gender and birth dates, (2) political identification, (3) political party membership [if any], (4) home ownership status, (5) range of annual household income, (6) your occupation, (7) education level, (8) your religious affiliation [if any]. You may “skip” providing these fields during the registration process and may choose to add it later or keep it blank. You can control which information is included in your configurable public profile. We may also use your location in order to enhance the relevance of content presented to you or to enable your followers to view it (with your permission only) and in order for advertisers to present you with more relevant offers. If activated, you may disable location sharing information at any time within the Platform if you choose not to share it at all or only while using the Platform, for example.
Public information
We do not make your user profile information nor information you post public; it is kept only within the Platform. If we ever decide that any of your information will be made outside of the Platform, we will update this terms of service agreement and you will be able to view those adjustments through the JANGAN app or website at any time.
Contact Information and Address Books
We use your contact information, such as your email address and/or phone number, to authenticate your account and keep it and our services secure, and to help prevent spam, fraud, and abuse. We also use contact information to personalize our services, enable certain account features (for example, for login verification), and to send you information about our Services. When you provide us with your phone number, you agree to receive text messages from JanGan to that number and we will normally only use that number for important and/or urgent messages such as user authentication and high priority notices. Other notifications will be provided through the app and website.
We may also use your contact information to connect advertisers to you on an anonymous basis. For example, we may include you within a certain group of Users that an advertiser may determine appropriate for a certain offer or communication. If we do so, we will only enable advertisers to send messages to a specific group or groups of Users and will not provide them with your direct contact information unless you explicitly permit us to do so.
You can choose to upload and sync your address book on the Platform so that we can help you find and connect with people you know and help others find and connect with you. We may also use this information to better recommend Content to you and others.
Direct Messages to Individuals and Groups
We provide certain features that let you communicate more privately or control who sees your content. For example, you can use Direct Messages and Group Messages (referred to as Chat in the Platform) to have conversations on JanGan that are kept between two individual Users or within a group of Users. When you communicate with others by sending or receiving Direct Messages or Group Messages, we will store and process your communications and information related to them. This may include link scanning for malicious content, link shortening, detection of spam and prohibited images, and review of reported issues. We also use information about whom you have communicated with and when to better understand the use of our services, to protect the safety and integrity of the Platform, and to show more relevant Content. We share the Content of your Direct Messages and Group Messages with the people you’ve sent them to. When you use features like Direct Messages or Group Messages to communicate, remember that recipients have their own copy of your communications on JANGAN – even if you delete your copy of those messages from your account – which they may duplicate, store, or re-share.
Payment information
At some time, you may provide us with payment information, including your credit or debit card number, card expiration date, CVV code, and billing address, in order to purchase offerings provided as part of our services or make contributions to a charity or political campaign. If and when we need payment information, we will employ third party secure processors to help you keep this information confidential and under strict control and limited access – for example, the Apple® and Google® payment systems or that of other third parties who we work with or may work with in the future. We understand this information is sensitive and prefer not to handle such information unless absolutely necessary or practical.
How You Control the Information You Share with Us
Your Privacy and safety settings let you decide:

Additional Information we Receive about You
We may receive certain information when you use our services or from other websites or mobile applications that may include our Content, and from third parties including advertisers. Like the information you share with us, we use the data below to operate our services.
Location information
We require information about your home address and active use location, which we may get from signals such as your IP address or device settings, to securely and reliably set up and maintain your account, to provide our services to you in a manner that is relevant and secure.
Subject to your settings, we may collect, use, and store additional information about your location – such as your current precise position or places where you’ve previously used the JANGAN – to operate or personalize our services including with more relevant Content like local trends, stories, ads, and suggestions for people to follow. You may disable certain location features within the settings feature.
Links
In order to operate our services, we may keep track of how you interact with links across our services. This includes links in emails we send you and links in content that appear on other websites or mobile applications. For example, if you click on an external link or ad on our services, that advertiser or website operator might figure out that you came from JANGAN, along with other information associated with the ad you clicked such as characteristics of the audience it was intended to reach. They may also collect other personal data from you, such as cookie identifiers or your IP address.
Cookies
A cookie is a small string of characters that is stored on your computer or mobile device. Like many websites, we may use cookies and similar technologies to collect additional website usage data and to operate our services. Cookies are not required for many parts of our services such as searching and looking at public profiles. Although most web browsers automatically accept cookies, many browsers’ settings can be set to decline cookies or alert you when a website is attempting to place a cookie on your computer. Certain services we provide may not function properly if you disable cookies. When your browser or device allows it, we may use both session cookies and persistent cookies to better understand how you interact with our services, to monitor aggregate usage patterns, and to personalize and otherwise operate our services such as by providing account security, personalizing the Content we show you including ads, and remembering your language preferences.
Log Data
We may receive information when you view content on or otherwise interact with our services, which we refer to as “Log Data.” For example, when you visit our website(s), sign into our services, interact with our email notifications, use your account to authenticate to a third-party service, or visit a third-party service that includes JANGAN content, we may receive information about you. This Log Data may include information such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device information (including device and application IDs), search terms, and cookie information. We may also receive Log Data when you click on, view, or interact with links on our services. We use Log Data to operate our services and ensure their secure, reliable, and robust performance. For example, we use Log Data to protect the security of accounts and to determine what content is popular on our services. We also use this data to improve the content we show you, including ads.
We use information you provide to us and data we receive, including Log Data and data from third parties, to make inferences like what topics you may be interested in, and what languages you may speak. This helps us better design our services for you and personalize the content we show you, including ads.
JanGan Site Data
When you view our content on third-party websites or apps that integrate JANGAN content such as JanGan message buttons, we may receive Log Data that includes the web page you visited. We use this information to better understand the use of our services, to protect the safety and integrity of our Platform, and to show more relevant content, including ads.
Other Third Parties and Affiliates
We may receive information about you from third parties who are not our ad partners, such as entities that help us evaluate the safety and quality of content on our platform, and other services you link to your JANGAN account.
We may use your profile and usage information for purposes of analytics, research and for improving the relevance of advertising, promotions or other engagement actions. This information may be aggregated into similar groups based on a wide variety of characteristics which when blended together may increase or decrease the relevance of a message or offer from an advertiser or from JANGAN product management itself. Among the operational uses of this information would be invitations to respond to Polls or Surveys within JANGAN as well as invitations to attend a public forum, Live Stream, Meet Up or other type of event.
Personalizing Across Your Devices
When you log into JanGan on a browser or device, we will associate that browser or device with your account for purposes such as authentication, security and personalization. Subject to your settings, we may also associate your account with browsers or devices other than those you use to log into JanGan (or associate your logged-out device or browser with other browsers or devices). We may do this to operate and personalize our services.
How You Control Additional Information We Receive
Your JANGAN profile and data settings may let you decide:

Information We Share and Disclose
As noted above, JANGAN is designed to broadly and instantly disseminate information you share within through our Platform. In the limited circumstances where we may disclose your private personal data, we do so subject to your control, because it’s necessary to operate our services, or because it’s required by law.
Sharing You Control
We may share or disclose your personal data with your consent or at your direction, such as when you authorize a third-party web client or application to access your account or when you direct us to share your feedback with a business.
If you’ve shared information like Direct Messages or protected content with someone else who accesses JANGAN through a third-party service, keep in mind that the information may be shared with the third-party service.
Service Providers
We may engage service providers to perform functions and provide services to us in or out of the India. For example, we may use a variety of third-party services to help operate our services, such as hosting our various content, to develop new functionality or enhance existing functionality and to help us understand the use of our services, such as Google Analytics. We may share your private personal data with such service providers subject to obligations consistent with this Privacy Policy and any other appropriate confidentiality and security measures, and on the condition that the third parties use your private personal data only on our behalf and pursuant to our instructions. We may share your payment information with payment services providers to process payments; prevent, detect, and investigate fraud or other prohibited activities; facilitate dispute resolution such as chargebacks or refunds; and for other purposes associated with the acceptance of credit and debit cards.
Law, Harm, and the Public Interest
Notwithstanding anything to the contrary in this Privacy Policy or controls we may otherwise offer to you, we may preserve, use, or disclose your personal data if we believe that it is reasonably necessary to comply with a law, regulation, legal process, or official governmental request; to protect the safety of any person; to protect the safety or integrity of the Platform, including to help prevent spam, abuse, or malicious actors on our services, or to explain why we have removed Content or accounts from our services; to address fraud, security, or technical issues; or to protect our rights or property or the rights or property of those who use our services. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your personal data.
Affiliates and Change of Ownership
In the event that we are involved in a bankruptcy, merger, acquisition, reorganization, or sale of assets, your personal data may be sold or transferred as part of that transaction. This Privacy Policy would apply to your personal data as transferred to the new entity. If such a transaction were ever to occur, we may then also disclose personal data about you to our corporate affiliates in order to help operate our services and our affiliates’ services, including the delivery of ads.
Non-personal Information
We may share or disclose non-personal data, such as aggregated information like the total number of times people engaged with a certain portion of Content, the number of people who clicked on a particular link or voted on a Survey, the topics that people are posting messages about in a particular location, or reports to advertisers about how many people saw or clicked on their ads.
Managing Your Personal Information with us
You may control the personal data you share with us. You can access or rectify this data at any time by visiting and editing your User Profile within the Platform. You may also deactivate your account. We provide you with tools and account settings to access, correct, delete, or modify the personal data you provided to us and associated with your account. You can retrieve certain account information, including your posted content, by visiting the User Profile.
Deletion
We keep Log Data for a limited period of time. You may deactivate or delete your account using the instructions and functions provided within the Platform. When deactivated, your JanGan account, including your display name, username, and public profile, will no longer be viewable on JanGan. For up to 30 days after deactivation it is still possible to restore your JanGan account if it was accidentally or wrongfully deactivated.
Object, Restrict, or Withdraw Consent
When you are logged into your JANGAN account, you can manage your privacy settings and other account features there at any time.
Children and our Services
Our services are available and encouraged for any full-time Indian resident 13 years and older. We believe the JanGan platform is a valuable educational tool for civic engagement and encourage teenage non-adults to use the platform freely in accordance with our Community Rules. If you are under the age of 13 you are not permitted to use this Platform until your 13th birthday.
Our Global Operations and Privacy Shield
Although JanGan is now available only for Indian residents, we fully intend to offer this service in other countries according to their local laws and customs in the near future. If you are attempting to use the Platform while traveling outside of the INDIA, we may invoke certain procedures to authenticate your use of your account to prevent fraudulent account or data access.
JanGan Community Rules
We believe that everyone should have easy access to official, tangible information about their representatives, laws and elections in order to form better-educated perspectives and opinions about how the government affects their lives and that of their communities. We feel this will empower the normal person and enable them to relay their perspectives to their colleagues and elected officials to affect and evolve change in a direction that is constructive for their families and communities. This will help energize and empower the public and that is why we chose to name the platform “JanGan.”
In order to provide an informative and enjoyable environment for the exchange of ideas and perspectives, we feel it is essential to implement clear rules and guidelines for user interaction on the JANGAN platform. This set of rules will evolve over time as we study and sense the balance between open expression and protection of the rights of our user community. These rules will therefore prohibit certain content that will be either unlawful or blatantly offensive to other users. At the same time, we do not want to unnecessarily inhibit open expression – rather, we want to encourage dialog and mutual understanding. We believe it is possible to express our points of view in a respectful manner, so that those who agree or disagree will have a greater mutual understanding, especially when others do not share our points of view or opinions.
The JANGAN Community Rules is a key component of our Terms, along with our Privacy Policy and other sections of this document which its acceptance, becomes an agreement between JanGan and each individual User. Therefore, all individuals accessing or using the Platform must adhere to the policies set forth in these Community Rules and the Terms overall. Failure to do so may result in one or more of the following enforcement actions:
• Requiring you to delete prohibited content before you can again create new posts and interact with other JANGAN users;
• Temporarily limiting your ability to create posts or interact with other JANGAN users;
• Asking you to verify account ownership with a phone number or email address; or
• Permanently suspending your account(s).
If you attempt to evade a permanent suspension by creating new accounts, we will suspend your new accounts.
Please note that we may need to change these Community Rules from time to time and reserve the right to do so. The most current version is always available within the Settings feature along with the Terms of Service and Privacy Policy. The policies set forth in these Community Rules govern organic content on our platform. To learn more about the rules which govern ads and promoted content, please review our Ads Policies.
Content Boundaries and use of JanGan Intellectual Property
Trademark: We reserve the right to suspend accounts or take other appropriate action when someone’s brand or trademark, including business name and/or logo, is used in a manner that may mislead or confuse others about your brand affiliation.
Copyright: We will respond to clear and complete notices of alleged copyright infringement. Our copyright procedures are set forth in our Terms of Service.
JanGan responds to copyright complaints submitted under the Digital Millennium Copyright Act (“DMCA”). Section 512 of the DMCA outlines the statutory requirements necessary for formally reporting copyright infringement, as well as providing instructions on how an affected party can appeal a removal by submitting a compliant counter-notice.
JanGan will respond to reports of alleged copyright infringement, such as allegations concerning the unauthorized use of a copyrighted image as a profile or header photo, allegations concerning the unauthorized use of a copyrighted video or image uploaded through our media hosting services, or content containing links to allegedly infringing materials. Note that not all unauthorized uses of copyrighted materials are infringements.
Note: In general, the photographer and NOT the subject of a photograph is the actual rights holder of the resulting photograph. If you’re unsure whether or not you own the copyrights to a work, or if you’re infringing upon someone else’s work, please consult an attorney or another advisor.
To submit a notice of claimed copyright infringement, you will need to provide us with the following information:

A physical or electronic signature (typing your full name will suffice) of the copyright owner or a person authorized to act on their behalf;

Identification of the copyrighted work claimed to have been infringed (e.g., a link to your original work or clear description of the materials allegedly being infringed upon);

Identification of the infringing material and information reasonably sufficient to permit JanGan to locate the material on our website or services;

Your contact information, including your address, telephone number, and an email address;

A statement that you have a good faith belief that the use of the material in the manner asserted is not authorized by the copyright owner, its agent, or the law; and
-
A statement that the information in the complaint is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
If you are reporting the content of a post, please give us a direct link to that post. Or please specify if the alleged infringement is in the header, avatar, etc. A LINK TO A PROFILE PAGE IS INSUFFICIENT FOR JANGAN TO IDENTIFY INFRINGIN MATERIALS
You can report alleged copyright infringement by sending a message to JANGAN’s Support Center and filing a copyright complaint. If you are logged in to JANGAN, you can visit the Support Center directly from your account by clicking the ‘Help’ link.
Filing a DMCA complaint is the start of a pre-defined legal process. Your complaint will be reviewed for accuracy, validity, and completeness. If your complaint has satisfied these requirements, we will take action on your request – which includes forwarding a full copy of your notice (including your name, address, phone and email address) to the User(s) who posted the allegedly infringing material in question.
We process copyright complaints in the order in which they are received. If you do not receive a ticket confirmation that means we did not receive your complaint and you should re-submit your complaint. However, please note, submitting duplicate copyright complaints will result in a delay in processing.
If we decide to remove or disable access to the material, we will notify the affected user(s) and provide them with a full copy of the reporter’s complaint (including the provided contact information) along with instructions on how to file a counter-notice.
If we remove or disable access to the materials reported in a copyright complaint, the reported user(s) will receive a copy of the complaint, including the reporter’s full name, email, street address, and any other information included in the complaint.
If you are uncomfortable sharing your contact information with the reported user(s), you may wish to consider appointing an agent to submit your DMCA notice on your behalf. Your agent will be required to submit the DMCA notice with valid contact information and identify you as the content owner that they are representing.
JanGan’s response to copyright complaints may include the removal or restriction of access to allegedly infringing material. If we remove or restrict access to user content in response to a copyright complaint, JanGan will make a good faith effort to contact the affected account holder with information concerning the removal or restriction of access, including a full copy of the complaint, along with instructions for filing a counter-notice.
If you’ve not yet received a copy of the copyright complaint regarding the content removed from your account, please respond to the support ticket we sent you.
Graphic Violence and Adult Content
Graphic Violence
We consider graphic violence to be any form of unpleasant media related to death, serious injury, violence, or surgical procedures. We consider adult content to be any media that is pornographic and/or may be intended to cause sexual arousal.
You may not post media that is excessively gruesome or share violent or adult content. Media depicting sexual violence and/or assault is also not permitted.
JANGAN’s intended use includes sharing information and examples of real-life stories – via posts such as text, photos, drawings, video or audio – and incidents that are informative but not intended to incite fear, intimidation, disgust or to be purposely offensive. Sometimes, this media can depict sensitive topics, including violent and adult content. We recognize that some people may not want to be exposed to sensitive content, which is why we balance allowing people to share this type of media with helping people who want to avoid it. Keep in mind that JANGAN welcomes users who are teenagers and not yet adults and we want the content to be acceptable to broad audiences in order to inform, educate and share meaningful points of view.
For this reason, content that you post cannot be purposely offensive, violent, gratuitously hateful, or intended for sexual arousal. If you share this content which you believe might offend certain members of our JanGan Community, you must mark your posts and/or account as sensitive. Doing so may result in our placement of images and videos behind an interstitial (or warning message), that needs to be acknowledged before your media can be viewed. Using this feature means that people who don’t want to see sensitive media can avoid it or make an informed decision before they choose to view it.
Under this policy, there are also some types of sensitive media content that we don’t allow at all, because they have the potential to normalize violence and cause distress to those who view them.
We group sensitive media content into the following categories:
Graphic violence which is a non-essential component of a real-life news story.
Graphic violence depicting death, violence, medical procedures, or serious physical injury in graphic detail. Some examples include, but are not limited to, depictions of:
-
Violent crimes or accidents;
-
Physical fights;
-
Physical child abuse;
-
Bodily fluids including blood, feces, semen, etc.;
-
Serious physical harm, including visible wounds; and
-
Severely injured or mutilated animals.
Note: exceptions may be made for documentary or educational content.
Adult Content
Adult content is any consensually produced and distributed media that is pornographic or intended to cause sexual arousal. Some examples include, but are not limited to, depictions of:
-
Full or partial nudity, including close-ups of genitals, buttocks, or breasts (excluding content related to breastfeeding);
-
Simulated sexual acts; and
-
Sexual intercourse or other sexual acts – this also applies to cartoons, hentai, or anime involving humans or depictions of animals with human-like features.
Note: exceptions may be made for artistic, medical, health, or educational content.
For content that was created or distributed without the consent of those featured, please refer to our non-consensual nudity policy.
Violent Sexual Conduct
Violent sexual conduct is any media that depicts violence, whether real or simulated, in association with sexual acts. Some examples include, but are not limited to, depictions of:
-
Rape and other forms of violent sexual assault, or sexual acts that occur without the consent of participants, including a simulated lack of consent; and
-
Sexualized violence – inflicting physical harm on an individual within an intimate setting, where it is not immediately obvious if those involved have consented to take part.
Gratuitous Gore
Gratuitous gore is any media that depicts excessively graphic or gruesome content related to death, violence or severe physical harm, or violent content that is shared for sadistic purposes. Some examples include, but are not limited to, depictions of:
-
Dismembered or mutilated humans;
-
Charred or burned human remains;
-
Exposed internal organs or bones; and
-
Animal torture or killing. Note: exceptions may be made for religious sacrifice, food preparation or processing, and hunting.
Hateful Imagery
Hateful imagery is any logo, symbol, or image that has the intention to promote hostility against people on the basis of race, religious affiliation, disability, sexual orientation, gender/gender identity or ethnicity/national origin. Some examples of hateful imagery include, but are not limited to:
-
Symbols historically associated with hate groups, e.g., the Nazi swastika;
-
Images depicting others as less than human, or altered to include hateful symbols, e.g., altering images of individuals to include animalistic features; or
-
Images altered to include hateful symbols or references to a mass murder that targeted a protected category, e.g., manipulating images of individuals to include yellow Star of David badges, in reference to the Holocaust.
Our aim is to limit exposure to sensitive images and videos and to prevent the sharing of potentially disturbing types of sensitive media unless it is central to the reporting of a real-life news story, incident or idea that merits the constructive exchange of ideas and healthy debate. For this reason, we differentiate our enforcement approach depending on the type of media that has been shared and where it has been shared.
Violent Sexual Conduct and Gratuitous Gore
We prohibit violent sexual conduct to prevent the normalization of sexual assault and non-consensual violence associated with sexual acts. We prohibit gratuitous gore content because research has shown that repeated exposure to violent content online may negatively impact an individual’s well-being. For these reasons, you can’t share images or videos that depict violent sexual conduct or gratuitous gore on JANGAN. Note: very limited exceptions may be made for gory media associated with newsworthy events or incidents that are central to constructive debate or exchange of ideas about issues.
To mark your media as sensitive, the system may request you to navigate to your safety settings and select the Mark media you post Content as containing material that may be sensitive option. If you don’t mark your media as sensitive, we may so manually if your content is reported for review.
You can report this Content for review in the JANGAN App and Website using the “Report” tool.
If you violate this policy, the first time you do so, we will require you to remove this content. We will also temporarily lock you out of your account before you can post content again. If you violate this policy again after your first warning, your account will be permanently suspended;
If you target someone with sensitive media in a clearly abusive or unsolicited way, we’ll require you to remove it under our abusive behavior policy and your account may be permanently suspended if the majority of your activity on JANGAN is sharing sensitive media.
If you believe that your account was suspended in error, you can submit an appeal.
If you share media that depicts violent sexual conduct or gratuitous gore anywhere on JANGAN, we will require you to remove this content.
If your account is dedicated to posting this type of content, your account will be immediately permanently suspended.
If you believe that your account was suspended in error, you can submit an appeal.
Adult content that was created or shared without the consent of those depicted is reviewed under our non-consensual nudity policy.
JANGAN may allow some forms of graphic violence and/or adult content in content posts when marked as containing sensitive media. However, you may not use such content in your profile or header images. Additionally, JANGAN may sometimes require you to remove excessively graphic violence out of respect for the deceased and their families if we receive a request from their family or an authorized representative.
Unlawful Use
You may not use our service for any unlawful purposes or in furtherance of illegal activities. By using JANGAN, you agree to comply with all applicable laws governing your online conduct and content.
Trends
At times, we may prevent certain content from trending. This includes content that violates the JanGan Community Rules, as well as content that may attempt to manipulate trends.
Trends are determined by algorithm and, by default, may be tailored for you based on who you follow, your interests, and your location. These algorithms identify topics that are popular now, rather than topics that have been popular for a while or on a daily basis, to help you discover the hottest emerging topics of discussion on JANGAN.
Profanity and Graphic Sexual References
The use of profanity is strongly discouraged in JANGAN. We encourage our users to find expressive words that are acceptable to a broad audience that includes teenage minors and members of devout religious groups. Using symbols to disguise the profane terms also is subject to violation of the Community Rules. We attempt to encourage expression in forms that are acceptable to a broad range of audiences, therefore the list of profanity terms will be ever evolving and the then current list prohibited terms will be available within the JANGAN FAQ page.
Third-party Advertising in Video Content
You may not submit, post, or display any video content on or through our services that includes third-party advertising, such as pre-roll video ads or sponsorship graphics, without our prior consent.
Misuse of JANGAN Badges
You may not use badges, including but not limited to the “promoted” or “verified” JANGAN Badges, unless provided by JANGAN. Badges is a general term used to describe a method of differentiating Users by level of use, for example a type of border around a photo and a descriptive term such as “Novice” or “Pundit”. Accounts using unauthorized badges as part of their profile photos, header photos, display names, or in any way that falsely implies affiliation with JANGAN or authorization from JANGAN to display these badges, may be suspended.
Misuse of Usernames
Selling usernames: You may not buy or sell JANGAN usernames.
Username squatting: You may not engage in username squatting. Some of the factors we take into consideration when determining whether conduct is username squatting include:
• the number of accounts created;
• the creation of accounts for the purpose of preventing others from using those account names;
• the creation of accounts for the purpose of selling those accounts; and
• the use of third-party content feeds to update and maintain accounts under the names of those third parties.
Please note that JANGAN may also remove accounts that are inactive for more than six months.
Please note that if an account has had no updates, no profile image, and there is no intent to mislead, it typically means there's no name-squatting or impersonation. Note that we will not release squatted usernames except in cases of trademark infringement. If your report involves trademark infringement, please consult those policies for instructions for reporting these accounts.
Attempts to sell, buy, or solicit other forms of payment in exchange for usernames are also violations and may result in permanent account suspension.
Abusive Behavior
In order to ensure that people feel safe expressing diverse opinions and beliefs, we prohibit behavior that crosses the line into abuse, including behavior that harasses, intimidates, or uses fear to silence another User’s voice.
Factors we may take into consideration prior to taking action to eliminate abusive behavior include, but are not limited to whether:
• the behavior is targeted at an individual or group of people;
• the report has been filed by the target of the abuse or a bystander;
• the behavior is newsworthy and in the legitimate public interest.
Violence and Physical Harm
You may not make specific threats of violence or wish for the serious physical harm, death, or disease of an individual or group of people. This includes, but is not limited to, threatening or promoting terrorism. You also may not affiliate with organizations that — whether by their own statements or activity both on and off the platform — use or promote violence against civilians to further their causes.
You may not promote or encourage suicide or self-harm. When we receive reports that a person is threatening suicide or self-harm, we may take a number of steps to assist them, such as reaching out to that person and providing resources such as contact information for our mental health partners.
You may not promote sexual exploitation of any kind and in particular the sexual or other exploitation of children. Learn more about our zero-tolerance child sexual exploitation policy. We have a zero-tolerance child sexual exploitation policy on JANGAN and towards any material that features or promotes child sexual exploitation, one of the most serious violations of the JANGAN Rules. This may include media, text, illustrated, or computer-generated images. Regardless of the intent, viewing, sharing, or linking to child sexual exploitation material contributes to the re-victimization of the depicted children. This also applies to content that may further contribute to victimization of children through the promotion or glorification of child sexual exploitation. For the purposes of this policy, a minor is any person under the age of 18.
The following behaviors are examples among those not permitted:
-
sharing fantasies about or promoting engagement in child sexual exploitation;
-
expressing a desire to obtain materials that feature child sexual exploitation;
-
recruiting, advertising or expressing an interest in a commercial sex act involving a child, or in harboring and/or transporting a child for sexual purposes;
-
sending sexually explicit media to a child;
-
engaging or trying to engage a child in a sexually explicit conversation;
-
trying to obtain sexually explicit media from a child or trying to engage a child in sexual activity through blackmail or other incentives; and
-
identifying alleged victims of childhood sexual exploitation by name or image.
Discussions related to child sexual exploitation as a phenomenon or attraction towards minors are permitted, provided they don’t promote or glorify child sexual exploitation in any way. Artistic depictions of nude minors in a non-sexualized context or setting may be permitted in a limited number of scenarios e.g., works by internationally renowned artists that feature minors.
If you think you've found a JANGAN account distributing or promoting child sexual exploitation, you can report it via the JanGan Platform. Provide the username and links to all relevant content that led you to believe the account should be reviewed.
In the majority of cases, the consequence for violating our child sexual exploitation policy is immediate and permanent suspension. In addition, violators will be prohibited from creating any new accounts in the future. Note: when we’re made aware of content depicting or promoting child sexual exploitation, including links to third party sites where this content can be accessed, they will be removed without further notice and may be reported to the appropriate law enforcement authorities.
Abuse and Hateful Conduct
You may not engage in the targeted harassment of someone or incite other people to do so. We consider abusive behavior an attempt to harass, intimidate, or silence someone else’s voice.
You may not direct abuse at someone by sending unwanted sexual content, objectifying them in a sexually explicit manner, or otherwise engaging in sexual misconduct. You may not promote violence against, threaten, or harass other people on the basis of race, ethnicity, national origin, sexual orientation, gender, gender identity, religious affiliation, age, disability, or serious disease.
We are committed to combating abuse motivated by hatred, prejudice or intolerance, particularly abuse that seeks to silence the voices of those who have been historically marginalized. For this reason, we prohibit behavior that targets individuals with abuse based on protected category.
Violent Threats
We prohibit content that makes violent threats against an identifiable target. Violent threats are declarative statements of intent to inflict injuries that would result in serious and lasting bodily harm, where an individual could die or be significantly injured, e.g., “I will kill you”.
We have a zero-tolerance policy against violent threats. Those deemed to be sharing violent threats will face immediate and permanent suspension of their account and may be reported to the appropriate law enforcement authority.
We prohibit content that wishes, hopes, promotes, or expresses a desire for death, serious and lasting bodily harm, or serious disease against an entire protected category and/or individual who may be members of that category. Saying that a group of individuals deserve serious physical injury, references to mass murder, violent events, or specific means of violence where protected groups have been the primary targets or victims. We prohibit targeting individuals with content that references forms of violence or violent events where a protected category was the primary target or victims, where the intent is to harass. We prohibit targeting individuals with content intended to incite fear or spread fearful stereotypes about a protected category, including asserting that members of a protected category are more likely to take part in dangerous or illegal activities.
Consequences
Under this policy, we take action against behavior that targets individuals or an entire protected category with hateful conduct, as described above. Targeting can happen in a number of ways, for example, mentions, including a photo of an individual, referring to someone by their full name, etc.
When determining the penalty for violating this policy, we consider a number of factors including, but not limited to the severity of the violation and an individual’s previous record of rule violations. For example, we may ask someone to remove the violating content and serve a period of time in read-only mode before they can post again. Subsequent violations will lead to longer read-only periods and may eventually result in permanent account suspension. If an account is engaging primarily in abusive behavior, or is deemed to have shared a violent threat, we may permanently suspend the account upon initial review.
You may not use hateful images or symbols in your profile image or profile header. You also may not use your username, display name, or profile bio to engage in abusive behavior, such as targeted harassment or expressing hate towards a person, group, or protected category.
Private Information and Intimate Media
You may not publish or post other people’s private information without their express authorization and permission. Definitions of private information may vary depending on local laws.
You may not post or share intimate photos or videos of someone that were produced or distributed without their consent.
You may not threaten to expose someone’s private information or intimate media. You also may not threaten to hack or break into someone’s digital information.
Impersonation
You may not impersonate individuals, groups, or organizations in a manner that is intended to or does mislead, confuse, or deceive others. While you may maintain parody, fan, commentary, or newsfeed accounts, you may not do so if the intent of the account is to engage in spamming or abusive behavior.
Spam and Security
You may not do, or attempt to do, any of the following while accessing or using JanGan:
-
Access, tamper with, or use non-public areas of the Platform.
-
Probe, scan, or test the vulnerability of any Platform system or network, or breach or circumvent any security or authentication measures.
-
Access or search, or attempt to access or search, JanGan by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by the JanGan Platform (and only pursuant to the applicable terms and conditions), unless you have been specifically allowed to do so in a separate agreement with JanGan. Note that crawling prohibited unless if done in explicit prior accordance with the provisions of JanGan.

Forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use JANGAN to send altered, deceptive, or false source-identifying information.
-
Interfere with or disrupt the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail- bombing JANGAN’s services, or by scripting the creation of content in such a manner as to interfere with or create an undue burden on JANGAN.
Any accounts engaging in the following activities may be temporarily locked or subject to permanent suspension:
-
Malware/Phishing: You may not publish or link to malicious content intended to damage or disrupt another person’s browser or computer or to compromise a person’s privacy.
-
Spam: You may not use JANGAN’s services for the purpose of spamming anyone. Spam is generally defined on JANGAN as bulk or aggressive activity that attempts to manipulate or disrupt JANGAN or the experience of users on JANGAN to drive traffic or attention to unrelated accounts, products, services, or initiatives. Some of the factors that we take into account when determining what conduct is considered to be spamming include:

if you have followed and/or un-followed a large number of accounts in a short time period, particularly by automated means (aggressive following or follower churn);
-
if your posts or Direct Messages consist mainly of links shared without commentary;
-
if a large number of people have blocked you in response to high volumes of untargeted, unsolicited, or duplicative content or engagements from your account;
-
if a large number of spam complaints have been filed against you;
-
if you post duplicative or substantially similar content, replies, or mentions over multiple accounts or multiple duplicate updates on one account, or create duplicate or substantially similar accounts;
-
if you post multiple updates to a trending or popular topic with an intent to subvert or manipulate the topic to drive traffic or attention to unrelated accounts, products, services, or initiatives;

if you send large numbers of unsolicited replies or mentions;

if you add users to lists in a bulk or aggressive manner;

if you are randomly or aggressively engaging with posts (e.g., likes, forwards, etc.) or users (e.g., following, adding to lists, etc.) to drive traffic or attention to unrelated accounts, products, services, or initiatives;

if you repeatedly post other people’s account information as your own;

if you post misleading, deceptive, or malicious links;
-
if you create fake accounts, account interactions, or impressions;
-
if you sell, purchase, or attempt to artificially inflate account interactions (such as followers, forwards, likes, etc.); and
-
if you use or promote third-party services or apps that claim to get you more followers, forwards, or likes (such as follower trains, sites promising “more followers fast”, or any other site that offers to automatically add followers or engagements to your account or posts).

Third Party Application Linkages
You are ultimately responsible for the actions taken with your account, or by applications associated with your account. Before authorizing a third-party application to access or use your account, make sure you've thoroughly investigated the application and understand what it will do. If automated activity on your account violates the JANGAN Community Rules or these automation rules, JanGan may take action on your account, including filtering your posts from search results or suspending your account.
You may not, directly or through a third-party application, send unsolicited Direct Messages in a bulk or automated manner, and should be thoughtful about the frequency with which you contact users via Direct Message.
Other General Rules for using JANGAN
Please do not:

Repeatedly post duplicate or near-duplicate content.

Abuse trending topics or hashtags (topic words with a # sign).

Send automated posts or replies.

Use bots or applications to post similar messages based on keywords.

Aggressively follow and un-follow people.
JanGan may automatically remove accounts engaging in these behaviors from search (or even suspend in some cases) in order to ensure the best experience for everyone.
FUND TRANSACTION AND ACCOUNTABILITY
Fund Transfer and Management
JanGan only enables the flow of funds from Donor to community and JanGan is not the final recipient of funds raised on its App. JanGan has zero commission policy on community donation. Payment gateway and services will deduct their applicable taxes and charges and transfer the net amount.
You are solely responsible for utilizing the funds for the Purpose mentioned in our fund-raising option in the app. The JanGan app is not responsible in any way whatsoever towards the end utilization of funds.
Fund Cancellation
JanGan reserves the right to reject, cancel, interrupt, remove, or suspend transfer of funds at any time and for any reason. JanGan is not liable for any damages as a result of any of those actions. JanGan’s policy is not to comment on the reasons for any of those actions.
Refund Policy
JanGan is not obliged to make refunds and may, in its discretion, decline any requests for refund of donations, particularly if request is made after 1 hour of donation made.
• If you would like your donation to JanGan to be refunded,
• You must request JanGan by writing an email for a refund and your request must reach JanGan within two days from the date on which you made the donation i.e. the date on which you: Made the donation online, electronically on JanGan mobile app.
The written request stating reason for requesting refund must be sent to the email address stated below and must contain all the following details pertaining to the donation:

Note: The transaction amount will go to respective community owners. The donation amount to be refunded depends solely on the community owners and not on JanGan.
In case of refund, amount will not be equal to donation amount as JanGan is bound to deduct transaction fees, processing fees, refund charges, GST and other charges.

THE “JANGAN ENTITIES” REFERS TO JANGAN, ITS PARENTS, SUBSIDIARIES, AFFILIATES, RELATED COMPANIES, DIRECTORS, OFFICERS, MEMBERS, MANAGERS, SHAREHOLDERS, EMPLOYEES, PARTNERS, LICENSORS, REPRESENTATIVES AND AGENTS. WITHOUT LIMITING THE FOREGOING, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, EACH OF THE JANGAN ENTITIES DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE JANGAN ENTITIES MAKE NO WARRANTY OR REPRESENTATION AND DISCLAIM ALL RESPONSIBILITY AND LIABILITY FOR: (I) THE COMPLETENESS, ACCURACY, AVAILABILITY, TIMELINESS, SECURITY OR RELIABILITY OF THE SERVICES OR ANY CONTENT; (II) ANY HARM TO YOUR COMPUTER SYSTEM, LOSS OF DATA,
OR OTHER HARM THAT RESULTS FROM YOUR ACCESS TO OR USE OF THE SERVICES OR ANY CONTENT; (III) THE DELETION OF, OR THE FAILURE TO STORE OR TO TRANSMIT, ANY CONTENT AND OTHER COMMUNICATIONS MAINTAINED BY THE SERVICES; AND (IV) WHETHER THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM THE JANGAN ENTITIES OR THROUGH THE SERVICES, WILL CREATE ANY WARRANTY OR REPRESENTATION NOT EXPRESSLY MADE HEREIN.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE JANGAN ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; OR (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE JANGAN ENTITIES EXCEED THE GREATER OF ONE HUNDRED INDIA DOLLARS (INDIA $100.00) OR THE AMOUNT YOU PAID JANGAN, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM. THE LIMITATIONS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT THE JANGAN ENTITIES HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
Indemnity
If anyone brings a claim, cause of action, or dispute against us related to your actions, content or information on JANGAN or other JanGan products or your use of the Services, JANGAN or other JanGan products, you’re access to or use of the Services, or your breach of these Terms, you agree, to the extent permitted by law, to indemnify, defend, and hold harmless each of the JanGan Entities from and against any and all complaints, charges, claims, damages, losses, costs, liabilities, and expenses of any kind (including legal fees and costs) related to any such claim, cause of action or dispute.
Updates to The Terms of Service and License Agreement
We may revise these Terms from time to time. The changes will not be retroactive and the most current version of the Terms, which will always be accessible within the Platform, will govern our relationship with you. We will try to notify you of material revisions, for example via a service notification or an email to the email associated with your account. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.
Term and Termination
The Term of this agreement begins upon your acceptance of these Terms. You may end your legal agreement with JanGan at any time by deactivating your account and discontinuing your use of the Services.
We may suspend or terminate your account or cease providing you with all or part of the Services at any time for any or no reason, including, but not limited to, if we reasonably believe: (i) you have violated these Terms or the Community Rules, (ii) you create risk or possible legal exposure for us; (iii) your account should be removed due to prolonged inactivity; or (iv) our provision of the Services to you is no longer commercially viable. We will make reasonable efforts to notify you by the email address associated with your account or the next time you attempt to access your account, depending on the circumstances. In all such cases, the Terms shall terminate, including, without limitation, your license to use the Services, except that the certain sections may continue to apply.
These Terms are an agreement between you and JanGan.
